Terms of Service

1. Acceptance of Terms

By registering for or using Kinyozi ("the platform", "the service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These terms apply to all users including shop owners, cashiers, and barbers.

2. Description of Service

Kinyozi is a cloud-based barbershop management platform providing point-of-sale, commission tracking, analytics, expense management, and financial reconciliation tools for barbershop owners across East Africa. The platform is accessed via web browser and requires an active internet connection.

3. Account Registration

  • You must provide accurate information when registering.
  • You are responsible for maintaining the security of your account credentials.
  • You must verify your email address before accessing the platform.
  • One account per shop owner. You may add staff under your shop account.
  • You must be at least 18 years old to register.

4. Subscription and Billing

  • Access to paid features requires an active subscription.
  • Subscriptions are billed monthly. The billing cycle starts on the date of your first payment.
  • A one-time first-month discount is applied automatically to your first payment. This discount cannot be transferred or reused.
  • Payments are processed by Paystack. By subscribing, you agree to Paystack's terms of service.
  • Subscriptions automatically expire after 30 days unless renewed.
  • A 3-day grace period is provided after expiry before access to paid features is restricted.
  • We do not offer refunds for partial billing periods.

5. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose.
  • Attempt to gain unauthorized access to other tenants' data.
  • Reverse engineer, decompile, or attempt to extract the source code of the platform.
  • Use automated tools to scrape or abuse the platform's APIs.
  • Resell or sublicense access to the platform without written permission (except Enterprise plan holders).
  • Enter false or misleading transaction data.

6. Data Ownership

You own your shop's data — transactions, staff records, and financial history. We do not claim ownership of your data. You may export your data at any time from your dashboard. By using the platform, you grant us a limited license to store and process your data solely to provide the service.

7. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance, infrastructure issues, or events beyond our control may cause temporary downtime. We will communicate planned maintenance in advance where possible.

8. Termination

You may cancel your account at any time from your billing dashboard. We reserve the right to suspend or terminate accounts that:

  • Violate these terms.
  • Engage in fraudulent activity.
  • Have outstanding unpaid balances after the grace period.

Upon termination, your data will be retained for 30 days before permanent deletion, giving you time to export any records you need.

9. Limitation of Liability

Kinyozi is provided "as is". To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the platform, including loss of revenue, data loss, or business interruption. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the platform after changes constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
